These Terms of Service ("Terms") govern your access to and use of the software ecosystems, modules, and websites operated by Webtirety Software SaaS Solutions ("Webtirety", "we", "us", or "our"). By accessing our platforms, you agree to be bound by these Terms and our Privacy Policy.
1. Enterprise Licensing and Access
Webtirety provisions software on a Software-as-a-Service (SaaS) basis. We grant you a revocable, non-exclusive, non-transferable license to access and utilize our modules for your internal business operations. You do not acquire ownership of the underlying codebase, architecture, or intellectual property. You may not reverse-engineer, decompile, or attempt to extract the source code of any Webtirety platform.
2. Product-Specific Operational Clauses
Because our platforms serve fundamentally different business logic, the following specific conditions apply to their respective modules:
Aero Business ERP & Specialized-Industry-Specific-Modules: Webtirety provides the architectural framework for inventory, ledger, and operational management. We guarantee system stability, but we are not liable for business losses resulting from inaccurate data entry, incorrect FIFO ledger management by your employees, or administrative errors made within your deployed instance.
Webtirety SEO Nexus: This platform is engineered to optimize server-side metadata and Open Graph architecture to industry standards. However, search engine algorithms (e.g., Google, Bing) operate independently. Webtirety provides no guarantee of specific organic ranking positions or traffic volumes.
3. System Uptime and Maintenance
We strive for 99.9% core uptime across our SaaS ecosystem. However, to combat system entropy, Webtirety occasionally performs scheduled server-side maintenance and architectural updates. We will provide advance notice for any maintenance that requires significant system downtime. We are not liable for temporary access disruptions caused by factors outside our direct control, including localized ISP failures or global cloud infrastructure outages.
4. Client Security Responsibilities
Structural integrity requires your participation. You are entirely responsible for maintaining the confidentiality of your Webtirety Nexus portal credentials and administrative accounts. Webtirety is not responsible for data breaches or operational disruptions caused by compromised client passwords or unauthorized access granted by your internal staff.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Webtirety Software SaaS Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill, resulting from your use or inability to use our software platforms. Our total liability in any matter arising out of or related to these Terms is limited to the amount you paid Webtirety for the specific software subscription in the twelve (12) months preceding the incident.
6. Jurisdiction and Dispute Resolution
These Terms are governed by the laws of India. Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts of competent jurisdiction located in Bhubaneswar, Odisha.
